Mayor and Mirkarimi testify in Ethics probe before dramatic disruption

Mayor Ed Lee testifies under oath before the Ethics Commission.
Mike Koozmin

After Sheriff Ross Mirkarimi endured about four hours of questioning in his official misconduct proceedings, mostly from Deputy City Attorney Peter Keith, Mayor Ed Lee took the stand a little after 1pm. But just as Mirkarimi attorney Shepherd Kopp was beginning to pin Lee down on the selective manner in which he decided to launch these unprecedented proceedings, the commission suddenly announced the hearing was being suspended and the room would need to be cleared immediately.

There is speculation that there was a bomb threat or other security emergency, but officials have so far offered no explanation for the dramatic development or whether the hearing would reconvene today. Yet the room is still half-filled with journalists and audience members, some speculating that that the clearing of the room was simply an effort to get the unusually grim-faced Lee off the hot seat.

Kopp's questioning included pointed questions about whether he consulted any members of the Board of Supervisors before deciding to bring official misconduct charges against Mirkarimi in March. The city's objection was overruled after Kopp noted that the supervisors will ultimately decide Mirkarimi's fate. Forced to answer under oath, Lee said no, he didn't speak to any supervisors before filing charges.

But progressive activist Debra Walker says Sup. Christina Olague -- women who are close political allies and speak regularly -- has repeatedly told her that Mayor Lee asked her opinion before filing the charges. If true, that would mean Mayor Lee committed perjury, which is a felony. Yet as reporters confronted Olague outside her office, she denied ever speaking with Lee about the case and then barricaded herself in her office.

When the reporters lingered and persisted, she finally emerged, reiterated her denial, refused to speculate about why her friend Walker would make that claim, and said, "We're not allowed to discuss this matter with anyone before it comes to the board...I may have to recuse myself from voting on this."

It was unclear why she thought recusal might be necessary, but if she does that would hurt Lee's effort to get the nine votes on the board needed to remove Mirkarimi.

We'll have complete analysis of the testimony and other developments in next week's Guardian.

She's still simmering with barely suppressed rage that she didn't win election or appointment to the Board and that her favored candidate for mayor lost. She's no different than a Republican who claims President Obama was born in Kenya.

inadequate and incompetent supervisorial candidate, who was profoundly rejected by the populace, looking for something, anything, to exact revenge.

Walker has about as much credibility as a small, smelly, smouldering pile of rodent feces, and arguably is less attractive.

Steven, when will you actually offer real, incisive commentary rather than conspiracy theories? Until then, you are frankly a waste of space, skin, energy and time.

Her chosen candidate for mayor was Herrera first.

Triple the rage and bitterness.

Posted by Troll II on Jun. 29, 2012 @ 4:12 pm

just hilarious. Are you having a contest to see just how mean, vile and just downright despicable you can be? I seriously doubt you even Debra Walker, so what could you possibly know about her state of mind? You sure know how to pile it on though, don't ya?

point here. Any chance you could try and keep up?

in order to criticize their politics and methods? Did you personally know George W. Bush? Did that stop you or anyone criticizing him?

Walker is fair game for criticism for being an infering busybody and for lying to try and skew the issues.

Posted by Guest on Jun. 30, 2012 @ 7:36 am

naturally. These Mirkarimi haters have absolutely -- absolutely! -- NO intellectual integrity. The crap they spout doesn't even have to make sense -- as we have seen -- but rather is only judged by how antagonistic it is to the truth and decency.

Posted by lillipublicans on Jun. 29, 2012 @ 7:32 pm

So we have the word of two people who have sworn an oath of office (Lee and Olague) versus the word of a well-known troublemaker and political loser - Walker.

Posted by Guest on Jun. 30, 2012 @ 12:38 pm

In the end, they just end up strangling themselves with it. No one likes people who are needlessly hateful and cruel. So, as they're busy turning people off through a lack of decency or scruples, they all but fail at convincing anyone but themselves. The funny thing is, they don't even realize it. You have to pity the poor fools.

Throwing labels and insults around is a sign you have no credible argument or point to make.

Posted by Guest on Jul. 01, 2012 @ 2:31 pm

then tell your fellow trolls, since all you ever do here is to throw around labels and insults.

Mine, too. Does that make me or her any less progressive?

She lives in D6, Ross vacated the D5 seat, where Christina Olague lives.

The mayor seems to be arguing that if he can't work with someone they have to be removed?

Posted by Guest on Jun. 29, 2012 @ 3:16 pm

sheriff who beat his wife, and he's inviting his colleagues to either testify if they have valid evidence or demur if they do not. Only SFBG could turn that into a conspiracy theory.

other than in your dreams and the mayor's dim-witted exclamations?

to everyone including Madison for his abuse, his anger and his lies. That plus images of the bruise leaves no doubt.

on Ivory Madison's big emailing efforts to destroy the Mirkarimi family..before she ever ......called the police.

donate the maximum amount to Mirkarimi's campaign for sheriff and hold a fundraiser for him as part of their conspiracy to destroy him too? That part always confuses me - they were supporters of his before all of this happened and now all of a sudden they're both charter members of a vast conspiracy to destroy him. How does that work? These conspiracies can become very confusing.

Posted by Troll II on Jun. 30, 2012 @ 3:00 pm

the might help you..particularly the declaration of Mr. Mertens , where he explains why , after he supposedly thought Mr. M was a horrid person, he decided to give him money. And when you finish getting up to speed by actually reading the record at might want to go to the ABC 7 website and search out Dan Noyes' I-Team investigation piece on Ivory Madison's busy little fingers..Do you think you can do that by yourself?

Posted by Guest on Jul. 01, 2012 @ 8:46 am

Noyes's latest hit piece is a new low for TV "journalism." Not only does it present redacted emails without context or an attempt to find out what was in them (did Noyes actually, like, try to contact the D.A.'s office?) or even how much was actually redacted, it says that, since Ivory Madison writes fiction sometimes, she's not capable of distinguishing fact from reality. I wonder how the many other fiction writers out there feel about that. Are they all suddenly not credible witnesses?

Posted by Guest on Jul. 01, 2012 @ 6:41 am

As the last survivor of a crime family eliminated by bloody rivalries among the mobs of Gotham City, the orphaned Helena Bertinelli grew into the mysterious vigilante known as the Huntress. New writer Ivory Madison shines a light on the dark underbelly of the mob world spanning from Gotham to Sicily, exploring exactly what led Helena away from a life in the Cosa Nostra criminal society and set her on a path of vigilantism. Also, find out more about Batman's first meeting with the fledgling female crime-fighter and why, to this day, they struggle to see eye-to-eye.

Posted by marcos on Jul. 01, 2012 @ 8:44 am

You do realize that's fiction, right? And that Helena Bertinelli's story was created by Joey Cavalleri, and that Madison's miniseries was just an fleshing out for DC's Year One line of Greg Rucka's Cry for Blood story? Madison was a pen for hire, and to draw some kind of conclusion between the Huntress's story and her trying to help her friend Eliana is a stretch that insults all fiction authors.

Posted by Guest on Jul. 01, 2012 @ 10:17 am

She self-describes as a radical feminist in her own bio. Is that a lie like the puffery about her lawyer-non-lawyer claims?

Posted by Guest on Jul. 01, 2012 @ 3:22 pm

I think it's rich that so-called progressives are suddenly jumping on someone for being a proud, radical feminist.

Posted by Guest on Jul. 08, 2012 @ 9:11 am

despite the redacted portions, there is enough to show that she sent out a lot of long, long, hearsay ridden, embellished emails to a bunch of people...well before she called police. The ruse is, Ms. Madison has claimed that she ONLY called police to see what would happen IF she called police, not thinking that her call would trigger an investigation. Considering what Noyes uncovered, that can't be true. Saint Madison had already been stirring up a pot of outrage, based on her own fabulist tendencies, and getting certain powerful individuals on board..before making a phone call designed to do exactly what it did. I imagine her now, clad in her burka(the nudity might make her prudish hubby soooo upset) praying at the altar of female vengeance superhero goddesses..praying that Eliana Lopez doesn't return. clue to Ms. Madison..prayer won't help. The woman you fear most..will soon arrive.

Posted by Guest on Jul. 01, 2012 @ 8:53 am

"That can't be true," huh? Did it occur to you that there might be personal info in the blacked out areas that might have nothing to do with the case?

Posted by Guest on Jul. 01, 2012 @ 10:19 am

things are redacted. You apparently don't know why they aren't. You need to see the Noyes piece on abc7 archives..IF you freeze frame some of the shots of redacted madison will see more than enough to support the inescapable fact ( supported in the reporting)that she asked certain people for help in avenging something she had never actually seen. It took her and her correspondents about four days to get all in order, before the call that Mr. Bronstein precisely directed her to make to the police.

Posted by Guest on Jul. 01, 2012 @ 12:51 pm

Who's the fabulist in this scenario, again?

Posted by Guest on Jul. 01, 2012 @ 10:23 am

what "redacted" means.

Posted by Guest on Jul. 01, 2012 @ 9:22 am

Why was Sheriff Hennessey's declaration so opposite the testimony of the Mayor's expert?

Why does the mayor think it so important that we do not know who he talked to as part of his deliberative process?

Posted by Guest on Jun. 29, 2012 @ 3:26 pm

Or, like Daly, is he craving the "power" he was compelled to give up?

Posted by Guest on Jun. 29, 2012 @ 3:41 pm

Or Jake McGoldrick. What about Gabs Haaland, Sue Hestor or Hydra Mendoza? Perhaps we can ask John Barbagelata's children, grandchildren or great-grandchildren what they think too? My cat has strong feelings on this issue - why should animal companions be excluded from this circus?

I'm on the edge of my seat awaiting their testimony.

32 years as sheriff of sf makes him an expert.

Posted by Guest on Jun. 29, 2012 @ 4:13 pm

This concerns the conduct of an elected official. And on that matter Hennessey's opinions counts as much as any SF voter.

being a self-absorbed, wife-beating asshole.

Hennessy CHOSE to not run for reelection. He could have easily won again, and he should have been appointed interim mayor, but Newsom didn't want someone in office who would truly show what a horrible job he had done...

Posted by JUsher on Jun. 29, 2012 @ 7:36 pm

on this issue matter when he's now a private citizen and was not involved in this process in any way, shape or matter?

In other news today - Mirkarimi admitted hitting his wife but said he feels the ethics committee can give him "redemption."

Posted by Troll II on Jun. 29, 2012 @ 3:42 pm

twice, and we can all reasonably infer it was more than that.

Not that it needs to be, as even one criminal act of violence is sufficient for the EC to confirm Lee's firing of Mirk, which is consistent with the 76% voter poll for Mirk to go.

Ross should stand down now to save the city the cost, and himself the public humiliation. But of course he is too arrogant and self-absorbed to ever do that.

Mirk is a spineless coward, a bully and threat to women everywhere.

Posted by Guest on Jun. 29, 2012 @ 3:56 pm

Yeah, you guys live in the gutter. Don't you ever get tired of spewing lies day after day?
Where do I begin? Ross never admitted to hitting his wife. How many times do we have to spell it out for you trolls? Grabbing does not equal beating. Repeat after me...Got a dictionary? Might want to use it.
Wife has said that what she meant by "twice" was arguing about the same topic, not another arm-grab. In the video, she also says they need help. She wanted to get couple’s counseling, not call the police. But the police dept strong-armed her there, didn’t they, as long as we are talking about coercive behavior. Eliana didn’t get to exercise her will in terms of what she felt was the right way to go about the couple’s difficulties.
Polls don't amount to much, except what do you expect if the newspapers don't do their job and report trash? ie, misinformation. But you guys suck it up, because, well, you see what you want to see. And like I said before, if it smells like the gutter and looks like the're all too happy to repeat/create more BS. You're really good at that, in case no one's told you lately.
Who's fault is the cost of this? The Mayor. He could have opted for a recall. Or tried to get all the facts on his own time. But he wasn't interested.
Gosh, the only bullies I see on a regular basis are all you spineless trolls, who seem to have nothing better to do than "beat up" on a man whose "crime" is that he has had anger management issues, which he is now addressing. I'm glad, by the way, he's addressing them.
But troll on, because I know your minds are in full gear when it comes to bashing…you seam to get a lot of pleasure out of it, day after day after day...Bully, you say? Look at yourselves in the mirror.

Posted by Daniele E. on Jun. 29, 2012 @ 6:55 pm

Domestic violence is a "crime" in quotes?

God you people are fucked. Ross is a psycho with serious mental issues. He's abusive to staff, he is abusive to constituents and I don't trust him after finding out he can't take care of his beloved "Theo". That man not only shouldn't have a gun or a badge, he should be in jail. Or a psych ward.

You know it's bad when someone supported by the POA looks sane by comparison. But you people love your abusive Ross! Sucks to be you people!

Posted by Inglorious Basterd Ross M. on Jun. 29, 2012 @ 7:11 pm

and you know it. He grabbed her arm, which is not the same as "hitting"her.

Posted by Guest on Jun. 29, 2012 @ 5:11 pm

That is correct. Arm grabbing is not the same as hitting her.

I know this because I watch MMA fights a lot. Things like arm grabbing and choking are different from 'striking'. But both can be effective in their own way.

Posted by Troll on Jun. 29, 2012 @ 8:51 pm

She's made this claim before, but on what basis---and at whose order---can Supervisor Olague claim that she's not allowed to talk about the case? She's an elected official who answers ultimately to her constituents, not some City Hall intimidation from---let me guess---the mayor's office.

Perjury from the Mayor.
